Won by the ÖH: The waiting period for student aid in the case of multiple studies (multiple enrollment) does not automatically begin with the semester in which only one study program is enrolled.

Student S changes his university studies after three semesters, which he started in the winter semester 2014, and starts a UAS study program in the summer semester 2016. However, he will remain enrolled in his undergraduate program until the end of the 2016 summer semester.

When he applies for a student grant to study at the FH in the winter semester of 2017, the application is rejected by the authorities. The authority is of the opinion that S only changed his studies in the winter semester of 2016 because he was still enrolled in his first degree program in the summer semester of 2016. After legal advice by the Social Department of the Austrian Student Union (ÖH), an appeal against the decision will be filed. It argues that the authority cannot unilaterally determine at what point a change of study was made. Rather, the student S would only have been obliged to report a change of study if he had received study grants for the study in question at that time, which was not the case here.
Consequently, the Senate of the Study Grant Authority corrects the legal opinion and the student S is already paid the grant as of the winter semester 2017.
